"New" 955 H locked down

I bought a 1964 955 H from a large eqiupment company by phone 1500 miles away that was in "excellent running condition, completely serviced and gone through, needed nothing." When it was unloaded and the truck pulled out of sight I drove it half a mile to where I needed to push down some trees. The tractor looked good with new paint, seats, lights and everything seemed to work perfect-even had great oil pressure. Pushed one tree and it started smoking and sputtering. I had checked the oil and water but had not checked the fuel level and figured that had to be running out. Shut it off and it was low, but not out. Got diesel, filled it and now starter turning slow. Boosted battery and got it running but very rough. Held at half thottle for 10 seconds until engine died. Would not turn over anymore. Called company I bought it from, they said no problem just call a local Cat mech. and we'll take care of it. Cat mech. found engine locked down, antifreeze in oil and oil filter full of metal. I called company and told them what the mech. said and they quickly changed their story to ALL USED EQIPMENT SOLD AS IS. They wouldn't even pay the Cat mech. that they told me to call! Question is, is it worth fixing the engine or should I look for a good running one to replace it. Serial number is 60A8905. After mechanic bill and lawyer fee the thing is a $18,000 piece of scrap metal. Anyone have any suggestions?

What I would do in this situation is not legal anywhere so I'll just shut up now.

Get a good diesel mech. to give an estimate and compare that to buying another machine, or sell it for what you can and just take the loss. Never take someones word as to how good a machine is without checking it out first. Sorry I can't do better than that.

When spending that kind of money, always take oil samples from all compartments, if the machine is worth considering, spending $15-$20 per compartment is not as big a loss if you do find something bad and dont buy the machine....
