The engine is out of warranty so i think you are out of luck as far as getting any compensation. I have run across an instance on an 8hp horizontal where there must have been a piece of metal from either the machining or assembly process that plugged the main bearing on the flywheel end and seized. Luckily that engine was still under warranty.
