Whether he likes to keep it topped off or not, it is improper to fill the radiator higher than the top of the core. I don't think removing the rubber seal has anything to do with it. If you have too much fluid, it's going to spill out somewhere. If pressurized it will go through the overflow vent. If non pressurized it will just shoot up through the cap.
