If it's what the oil looks like on the dipstick (if it were a bad HG it would look blacker) I'd first see if the valve cover wants tightening. Even a new cover gasket is an easy fix, but you have to get the gasket.
The strength of a refund demand depends on the seller's undertakings around the purchase.
